Terms of Service

These terms are the agreement between you and ApiMoni. The two sections most worth reading are section 4, which sets out what you may point ApiMoni at, and section 7, which explains why you should not rely on ApiMoni as your only safeguard.

1. This agreement

These Terms of Service govern your access to and use of ApiMoni (the “Service”), operated by Tuncay Altinpulluk (“we”, “us”). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal data and forms part of this agreement.

2. What the Service does

ApiMoni sends periodic HTTP requests to endpoints you configure, records whether each request succeeded, how long it took and what status code came back, and notifies you by email when an endpoint fails or recovers according to the thresholds you set. It can optionally inspect a TLS certificate and warn you before it expires.

Certificate monitoring is advisory. A certificate problem is reported to you but is not counted as downtime and does not affect your uptime statistics. Certificate revocation is not checked.

3. Your account

You must be at least 16 years old and able to enter a binding contract. You agree to provide accurate registration details and to keep them current. You are responsible for everything that happens under your account and for keeping your password and any linked sign-in method secure. Tell us promptly at support@apimoni.com if you believe your account has been compromised.

One person or organisation may not maintain multiple free accounts to evade plan limits.

4. Acceptable use

ApiMoni sends real traffic to whatever address you give it. This section is what keeps that from becoming a problem, and we enforce it.

You may only monitor endpoints that you own, operate, or have explicit permission from the operator to monitor.

You must not use the Service to:

  • send traffic to a third party’s systems without their permission, whether to probe, scan, benchmark or otherwise;
  • generate load intended to degrade, overwhelm or deny service to any system — ApiMoni is a monitoring tool, not a load-testing or stress-testing tool;
  • circumvent the minimum check intervals, endpoint limits or rate limits of your plan, including by scripting, automating or distributing account creation;
  • break any law, infringe anyone’s rights, or access data you are not authorised to access;
  • probe, scan or test the vulnerability of the Service itself, or interfere with its operation or with other users;
  • resell, sublicense or offer the Service to third parties as your own without our written agreement.

You are responsible for the content of the requests you configure, including any headers or body you supply, and for having the right to send them.

5. Plans, limits and fees

Each plan caps how many endpoints you can monitor, how frequently they may be checked, the minimum response-time threshold you can set, and how long monitoring history is retained. Current limits are shown in the application and are enforced when you create or edit an endpoint. We may change plan limits, and will give reasonable notice before reducing the limits of a plan you are on.

The Service is currently provided free of charge. If we introduce paid plans, the price, billing period and cancellation and refund terms will be presented to you before you purchase, and no charge will be made without your explicit agreement.

6. Your data

You keep all rights in the configuration and content you put into the Service. You grant us only the permission we need to operate it for you: to store your configuration, send the requests you have set up, record the results and deliver your alerts.

Monitoring records store up to 5,000 characters of each response body. Please do not point the Service at endpoints that return sensitive personal data, and prefer a dedicated least-privilege credential when a monitored endpoint requires authentication. 7. Availability, alerts and what you should not rely on

We work to keep ApiMoni running, but we provide it “as is” and do not commit to any specific uptime, and we may suspend it for maintenance, changes or circumstances outside our control.

You should not rely on ApiMoni as your only means of detecting an outage. Checks may be delayed, missed or wrong, and alerts may be delayed, undelivered or filtered as spam, including for reasons entirely outside our control such as email delivery failures. If an outage would cause you serious harm, keep an independent safeguard in place.

8. Third-party services

The Service uses Google for optional sign-in and MailerSend to deliver email. Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions. The endpoints you monitor are likewise your responsibility, not ours.

9. Our intellectual property

The Service, including its software, design and branding, belongs to us and our licensors. These terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with them, and nothing more. You may not copy, modify, reverse engineer or create derivative works from the Service except to the extent the law says you may.

10. Suspension and termination

You can stop using the Service at any time, and can ask us to delete your account by emailing support@apimoni.com. Deleting an endpoint permanently deletes its monitoring history.

We may suspend or terminate your account if you breach these terms — in particular section 4 — if required by law, or if your use threatens the security or stability of the Service or a third party. Where circumstances reasonably allow, we will warn you first. On termination your right to use the Service ends and we may delete your data.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that its monitoring results or alerts will be accurate, complete or delivered.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, data, goodwill or business, arising out of or relating to your use of the Service — including any loss caused by a missed, delayed or inaccurate check or alert, or by an outage the Service failed to report.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or EUR 100.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all rights the law gives you that cannot be waived.

13. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms or from your use of the Service, including any claim by an operator whose systems you monitored without permission.

14. Changes

We may change these terms as the Service develops. The “last updated” date above always reflects the current version, and we will give you reasonable notice by email before a material change takes effect. Continuing to use the Service after a change takes effect means you accept the revised terms.

15. Governing law and general terms

These terms are governed by the laws of the Republic of Türkiye, and the courts of the Republic of Türkiye have exclusive jurisdiction over any dispute, except that if you are a consumer you may bring proceedings in the courts of your country of residence.

If any provision is found unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it to an affiliate or in connection with a merger or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between us regarding the Service.
